I understand all of your frustrations.

I am just happy that we are allowed to keep the image on the site and I am also happy with the way Peter has responded, as I would really not like to loose him as a mate and also hosting his great artwork.

Please don't let this thread turn into another angry one about copyright issues.

Thanks

Don't worry, eveofthewar, I for one will not be doing so!

I'm leaving the issue here.

If Jeff's people say anything to you, refer them in my direction, I'll be happy to tell them directly what I think.

Loz wrote: Just want to say that the whole thing is shocking really. Isn't anybody aloud to paint a scene from War of the Worlds? As long as the machines don't too closely resemble another artists. And lets face it , there are so many different takes on the machines. Some look similar and some as in the case of Peter's look very different to any others. I can't think of one that looks atall like Peter's. Surely anyone can paint an image described in the book?
I realy don't know Loz, I have had a similar problem before with an image I did of the Titanic. someone said it looked too much like another artists work, it did because the person who commissioned the piece said 'the copyright had been taken care of' and gave me the picture to copy from, He was wrong and I had to paint the picture again, Got paid twice after the second picture went to print we were told we could have used the first one so long as we didn't use the other artists name or try to pass it off as his work , which we wouldn't have.
If you think about it, how many copies of famous paintings have you seen?, hundreds I'd bet. I think the copyright problem is with the book and not Trim's Thunder Child image. because I have depicted a scene from the book and called it 'The Thunder Child' thats the problem(I am told Jeff owns the copyright to TWOTW). If I where to remove any text reference from my image that refered to the book it might be OK. I don't know and would have to speak to a lawyer and that costs. there is only justic if you are rich enough

Why do we have to choose, surely you should be painting them all

At the end of the day your a real talent and we are buzzing of your depictions of War of the Worlds.

You've covered a lot of bases already. How about the scene with all the drunks, with the lights on at night and the martian watches them and then takes victims. do you know the one i mean? its a really spooky part of the book. but the idea of those people letting go and paying for it is horrifying.

Yes I know the scene you are talking about, it's from book 2: chapter 7; The Man on Putney Hill.

The artilleryman began to tell me of the sort of people who still remained in London.
“One night last week, he said, “some fools got the electric light in order, and there was all Regent Street and the Circus ablaze, crowded with painted and ragged drunkards, men and women, dancing and shouting till dawn. A man who was there told me. And as the day came they became aware of a fighting-machine standing near by the Langham and looking down at them. Heaven knows how long he had been there. It must have given some of them a nasty turn. He came down the road towards them, and picked up nearly a hundred too drunk or frightened to run away.
Grotesque gleam of a time no history will ever fully describe!

It might be an idea to do it from the Martians point of view.

OK any more?

How about the four Martians carrying away the wrecked remains of their comrade at Shepperton and Weybridge?

Or the great pit at Primrose Hill?

Or the Martians at work in the pit by the house with the Narrator and Curate?

Or...?

Ooh, there are so many!

Perhaps the destruction of a train track complete with train.

A shot of the fyling machine over a ruined London with tripods in the distance might be cool.

The Martians have altered it anyway, so you could cart blanch the whole thing, and just go for it.

They've rocked for over 30 years don't know about the Native American name though, I've not heard that before.

That's a strange thing, you are right the links I put in no longer work, but a link posted by 'McTodd' still does I wonder why that is?

well i have to say thats an excellent piece of artwork, its the first time ive seen an image of a tripod being destroyed actually, ive seen pictures of them abandoned at the end of the story but never actually being destroyed which is strange because it happens to three, possibly four in the book (one at Weybridge and Shepperton and at least two in the battle between the Thunder Child and the Martians, the fate of the third was not clear).
Reading back over the post i can't believe there was copyright issues over your picture, its clearly different to any so called "official" pictures.

Cheers Leper
I think the copyright problem was just with the title, as soon as Lee removed it, it all went quiet.
